Woburn, MA – September 17, 2008 – A date has been set for the retrial of a New Hampshire man charged with killing his ex-lover’s husband and another man at a cement mixing firm in Wakefield. A mistrial was declared Aug. 26 after a Middlesex Superior Court jury said it was hopelessly deadlocked on the charges against Sean Fitzpatrick.
District Attorney Gerald Leone announced Wednesday that a second trial for Fitzpatrick will begin Jan. 20.
Fitzpatrick was accused of fatally shooting Michael Zammitti Jr. after Zammitti’s wife, Michelle, ended their affair. Zammitti was the owner of Allstate Concrete Pumping. Prosecutors said Chester Roberts, an employee of the company, was also shot when he entered the room at the wrong time.
Fitzpatrick testified that he was asleep at his home in Freedom, N.H., at the time of the shootings.
